Terms & Conditions

These Terms and Conditions govern access to and use of the PIATR mobile application and any related web services, content, features, and services offered through PIATR, including but not limited to meal planning, recipe management, shopping list creation, nutritional tracking, and any other current or future functionality made available through the application.

By accessing, registering, or using PIATR, the user declares that they have read, understood, and fully accept these Terms and Conditions. If the user does not wish to accept them, they must refrain from using the application.

1. Definitions

For the purposes of these Terms and Conditions, the following terms shall have the meanings set forth below:

  • Application or PIATR: refers to the mobile application, website, management panels, digital services, and all related functionalities.

  • User: refers to any natural or legal person who accesses or uses PIATR.

  • Account: refers to the personal profile created by the user to access certain application features.

  • Content: refers to texts, images, recipes, nutritional data, lists, meal plans, comments, graphic materials, logos, software elements, and any other content present on PIATR.

  • Services: refers to all functionalities, tools, and performances provided through PIATR.

  • Owner: refers to the entity that manages, controls, and makes PIATR available.

2. Purpose of the Service

PIATR is a digital platform designed to assist the user in organizing meals, creating weekly or customized menus, managing recipes, planning shopping, and, where applicable, consulting nutritional data and other information useful for daily food management.

The information made available through PIATR is for organizational, informational, and supportive purposes only. PIATR does not provide medical, diagnostic, therapeutic, or healthcare services, except for any integrations expressly declared as such and permitted by applicable law.

3. Registration and Account

To use certain PIATR features, creating a personal account may be required. The user undertakes to provide truthful, accurate, up-to-date, and complete information during registration and to keep it constantly updated.

The user is responsible for the confidentiality of their access credentials and all activities carried out through their account. In case of unauthorized or suspected use of their account, the user must promptly notify the Owner.

The Owner reserves the right to suspend, limit, or delete an account in case of violation of these Terms and Conditions, unlawful use of the platform, or reasonable suspicion of fraudulent, abusive, or harmful activity.

4. Usage Requirements

The user declares and warrants that they have the legal capacity necessary to accept these Terms and Conditions.

If the user is a minor, use of PIATR is permitted only within the limits provided by applicable law and, where required, with the consent of a parent or legal guardian.

The user undertakes to use PIATR in a lawful, proper manner, in compliance with these Terms and Conditions, current legislation, public order, and common decency.

5. License of Use

The Owner grants the user a limited, non-exclusive, non-transferable, revocable, and non-sublicensable license to use PIATR solely for personal, domestic, or otherwise permitted purposes under these Terms and Conditions.

This license does not transfer to the user any intellectual property rights over PIATR, the software, design, content, or trademarks present on the platform.

It is prohibited to copy, modify, distribute, sell, assign, sublicense, decompile, disassemble, reverse engineer, or otherwise attempt to obtain the source code of the application, except within the non-derogable limits provided by law.

6. Content and Features

PIATR may include, among other things:

  • recipe entry;

  • meal planning;

  • menu generation;

  • ingredient and quantity management;

  • automatic or manual shopping list creation;

  • indicative calculation of calories, macronutrients, or other nutritional values;

  • saving of dietary preferences;

  • data synchronization across devices;

  • possible use of third-party services.

The Owner reserves the right to modify, suspend, add, or remove features at any time, with or without notice, within the limits permitted by law.

7. Accuracy of Information

PIATR may process, display, or suggest information related to foods, recipes, nutritional values, quantities, portions, shopping lists, and estimated costs. Such information may depend on data provided by the user, external sources, or calculation algorithms and may therefore contain inaccuracies, omissions, or approximations.

The Owner does not guarantee that nutritional data, portions, cost estimates, preparation times, or any other information present in the application is always complete, up-to-date, or error-free.

The user must independently verify the accuracy of the information before relying on it, especially in the presence of allergies, intolerances, specific dietary needs, illnesses, or food restrictions.

8. Exclusion of Medical Advice

The information on PIATR does not constitute medical, professional nutritional, dietary, pharmacological, or personalized healthcare advice in any way.

The user must not use PIATR as a substitute for the opinion of a doctor, dietitian, nutritionist, or other qualified healthcare professional.

In case of pregnancy, breastfeeding, eating disorders, allergies, diabetes, metabolic diseases, chronic illnesses, or any other medical condition, the user must consult a healthcare professional before following meal plans or recommendations present in the application.

9. Allergies, Intolerances, and Food Safety

The user is solely responsible for verifying ingredients, compatibility with their allergies or intolerances, and the safety of consumed foods.

PIATR may offer allergen filtering, labeling, or reporting tools, but does not guarantee in any way the absolute absence of cross-contaminations, input errors, or omissions by third parties or the user themselves.

The Owner disclaims any liability for damages, adverse reactions, contaminations, preparation errors, or misuse of foods, except in cases of fraud or gross negligence where not excludable by law.

10. User Content

The user may upload, enter, or create content within PIATR, including recipes, notes, preferences, lists, and personal information.

The user retains ownership of the content they generate but grants the Owner a worldwide, free, non-exclusive, transferable, and sublicensable license, limited to what is necessary to operate, provide, improve, and promote PIATR and its services. This includes the right to store, display, reproduce, modify, distribute, and create derivative works from such content.

The user represents and warrants that their content does not violate any third-party rights, including intellectual property, privacy, or personality rights, and does not contain unlawful, defamatory, offensive, or harmful material.

The Owner reserves the right to review, moderate, remove, or refuse to display any user content at its sole discretion, without prior notice.

11. Intellectual Property

All rights, titles, and interests in PIATR, including software, designs, trademarks, logos, content, databases, and any other material, are and remain the exclusive property of the Owner or its licensors.

No provision in these Terms and Conditions shall be construed as granting the user any right or license beyond what is expressly stated herein.

12. Third-Party Services and Links

PIATR may integrate or link to third-party services, websites, or resources (e.g., nutritional databases, shopping platforms, payment processors). The Owner does not control, endorse, or assume responsibility for such third parties.

Use of third-party services is at the user's own risk, subject to their respective terms and conditions. The Owner disclaims any liability arising from such use.

13. Payments and Subscriptions

Certain PIATR features may be subject to payment, such as premium subscriptions, in-app purchases, or additional services. All payments are processed securely through third-party providers.

The user authorizes recurring payments where applicable and agrees to keep payment information updated. Subscriptions may auto-renew unless canceled.

Refunds are granted only at the Owner's discretion or as required by law. Full details are provided during the purchase process.

14. Data Protection and Privacy

Use of PIATR is governed by the Owner's Privacy Policy, which is incorporated herein by reference. By using PIATR, the user consents to the collection, processing, and storage of personal data as described therein.

The Owner implements reasonable technical and organizational measures to protect user data but cannot guarantee absolute security.

15. Limitation of Liability

To the fullest extent permitted by law, the Owner, its affiliates, officers, employees, and agents shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to use of PIATR, including loss of data, profits, or goodwill.

Total liability shall not exceed the amount paid by the user in the twelve months preceding the claim.

The Owner is not liable for user-generated content, third-party materials, or inaccuracies in nutritional or other data.

16. Indemnification

The user agrees to indemnify and hold harmless the Owner from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from their breach of these Terms and Conditions, violation of third-party rights, or unlawful use of PIATR.

17. Termination

The Owner may terminate or suspend access to PIATR at any time, with or without cause, immediately upon notice.

Upon termination, all licenses granted herein cease, and the user must delete all copies of the application.

Provisions that by nature should survive termination (e.g., intellectual property, liability, indemnification) shall do so.

18. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of Italy, without regard to conflict of law principles.

Any disputes shall be resolved exclusively by the competent courts of Milan, Italy.

19. Changes to Terms and Conditions

The Owner reserves the right to update these Terms and Conditions at any time. Continued use of PIATR after changes constitutes acceptance thereof.

Users will be notified of material changes via in-app notice or email.

20. Miscellaneous

If any provision is held invalid or unenforceable, the remaining provisions remain in full force.

No waiver of any breach constitutes a waiver of subsequent breaches.

These Terms and Conditions constitute the entire agreement between the parties regarding PIATR.
